Terms & Conditions

1. Introduction

These Terms and Conditions (T&Cs) regulate your relationship with Northern Harvest Limited (a company registered in England with company number 4383263 and whose registered office is at Kenyon Hall Farm, Croft, Warrington, WA3 7ED ("Northern Harvest", "we", "our" or "us") and all orders that you may make for the products advertised for sale by us (the "products") via the Northern Harvest website, www.northernharvest.co.uk (the "website"). Please read these T&Cs carefully as they may affect your rights and liabilities under the law. If you do not agree to these T&Cs you will not be able to order from Northern Harvest.

1. Revisions and Amendments

We reserve the right to revise or amend  these T&Cs from time to time.Please check periodically for changes. If you do not agree with any of the revised or amended T&Cs you will not be able to order from Northern Harvest.


2. Registration

2.1. To order from Northern Harvest, you must register an account with us. This is referred to as 'set up an account'. However, this is not a credit account; payment will be required upon delivery of goods. This account can be set up by following the instructions on the website.

2.2. To register with Northern Harvest you must be over eighteen years of age or, if you are a business, it must be operated by a person over the age of eighteen.

2.3. You must ensure that the details provided by you on registration or at any time are complete and accurate.

2.4. You must inform us promptly of any changes to the information that you provided when registering by updating your personal details before placing your next order.

2.5. The personal and payment details you give to us are governed by a strict privacy policy. Please see our Privacy Policy.   

2.6. Following your set up of an account, we will email confirmation to you. For your records, please print or save this email, and also, if you wish, print or save these T&Cs for your future reference.


3. Password and security

3.1. When you register you will be asked to create a password. You must keep this password confidential and must not disclose it toanyone. You will be responsible for all transactions and orders that are submitted with your password. If you know, or suspect, that someone else knows your password you should notify us by contacting us immediately. We would also suggest that you also change your password immediately.

3.2. If Northern Harvest has any reason to believe that there is likely to be a breach of security or misuse of the Northern Harvest website, we may require you to change your password or we may suspend or cancel your account.   

4. Payment

4.1 Except for the circumstances set out in paragraph 4.6, you must ensure that Northern Harvest are provided with details of a valid credit or debit card bearing either the MasterCard or Visa symbol. You must update us with any change to these details before placing another order. You can make changes to your details by selecting the appropriate option at the final stage of the checkout at the Adflex Hosted Payment Page (AHPP).

4.2 Your card payment details will be held by a fully PCI DSS level 1 compliant third party provider Adflex. This means their transaction data protection meets the industry's most rigorous security standards. They are encrypted, stored and processed by Adflex, and are inaccessible to any Northern Harvest staff or any other third party.

4.3 Your card will be charged for the goods and authorised on the day before delivery. We have no control of how long it takes the bank to process the payment.

4.4 We will suspend deliveries to you and end our agreement with you if we are refused authority from your card issuer for payment or we reasonably believe that a payment will be refused. You agree to recompense us in full for all reasonable costs and expenses, including reasonable legal costs and expenses,which we incur in obtaining payments due from you that you have not made in accordance with your agreement with us as set out in these T&Cs.

4.5 If a payment has been rejected by your bank, we reserve the right not to deliver your order. You must then contact us to arrange payment and wait for that payment to go through before we will deliver the order.

4.6 Alternative payment methods such as a cheque may be accepted for customers at our discretion by prior agreement, and can be arranged by calling us via the contact details on the website. If you pay by cheque we cannot guarantee when this will be paid in by us and when the amount will be taken from your account.

5. Purchases

5.1. You must be eighteen years old or over to purchase alcohol from Northern Harvest. If you have ordered alcohol from us and cannot be at home when the delivery is made, you are responsible to make sure that a suitable person aged eighteen or older is there to receive the order.

5.2. You may make orders for products by using our website at any time after you have created an account. The website and our communications to you will be in English. The website allows you to review your order or orders and make any corrections before submitting it to us and by submitting the order you confirm that you have made any such corrections.

5.3 Each product for which you click 'Add to basket' is added to a 'shopping basket' . You are given the opportunity to review the quantity of each item in your shopping basket when you choose 'check out & deliver'. You can change or cancel the purchase of each of the products completely, at this stage, at any time before clicking 'place order'. After you have clicked 'place order' and after our acceptance of your order, items are added to your delivery in addition to any items that you have previously ordered. The deadline is currently midday on Tuesday for that week’s deliveries (This may be different for Christmas deliveries).

5.4. Your submission of an order amounts to an offer to enter into a contract to buy the products from us.You can’t then withdraw or cancel your order except as stated below.

5.5. No order is accepted from you until our website displays an order confirmation message. This message is displayed after you click 'confirm order' in the shopping basket/order summary page. When you order by telephone, your order will be accepted (or possibly rejected) verbally by our staff. A contract for the sale of products to you arises on our acceptance of your order.

5.6. When we accept an order, we do all that we can to make sure that your order is fulfilled. Products are, however, subject to seasonal availability and other market conditions and we do not always know if a product is, or will be, available at the time of accepting an order. If we are unable to deliver an item you have ordered, we may offer a reasonable substitute. You may reject that substitute, and you will not be charged for it, or, if you have paid already, we will refund any amount paid for it. If we do not offer a substitute, we will remove the product from your order so that you are not charged or, if you have paid already, we will refund you the price. We will, however, bear no liability for the unavailability of products. If you do not wish us to make any substitutions please let us know when registering.

5.7. The price that we charge you for the products may change from time of ordering to time of delivery, due to market fluctuations.

5.8 All our products are subject to seasonal changes in supply levels and prices. If you have a standing order or are using an old order to make a new one the prices for certain products may be different from the price paid when first ordered by you. We recommend that you check the website regularly. The website still allows you to review all the products and prices before you order from us, and make amendments and corrections to them until the order is confirmed.

5.9. Some of our products are priced by weight (for example, some meat and cheese products). We show the prices for weights on the website. The average weight and price shown is for guidance only; the weight you receive may vary from this guide and the price you are charged will be for the weight of product delivered. Where this is applicable it is marked on the website with an asterix (*).   

5.10. You are obliged to pay for an order once it has been confirmed unless it has been cancelled prior to our deadline. The onus is upon you to make sure we have received and understood the cancellation. The deadline for all deliveries is currently noon on Tuesday for that week’s deliveries. (This may be different for Christmas deliveries).

5.11.If you suspect your card has been used fraudulently please contact us and your card issuer.

5.12. We sell only to the final consumer and our products are not for re-sale. Please contact Northern Harvest for wholesale arrangements.

5.13 All prices for products are inclusive of any applicable VAT.


6. Delivery of Products and Acceptance thereof.

6.1. We will make deliveries to your address as stated when you set up an account or an update to that address. We reserve the right not to deliver to all locations and we will tell you when you apply to register an account with us whether we can deliver to your address or not. You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. In the event that your delivery is stolen from your doorstep or damaged while there we do not accept liability, and will offer compensation only at our discretion. We reserve the right to refuse to accept orders from any customer. Considerations of delivery problems may give rise to such a refusal. Any changes to address details must be made before the order deadlines published on our website (currently midday on the Tuesday of the week of delivery). We ask for standard delivery instructions to be made when first registering. Any temporary delivery instructions can be made at checkout for that week’s delivery.

6.2. We endeavour to keep your delivery day (and approximate time) the same each week, but we reserve the right to change it temporarily or permanently and will tell you if we do so, this is especially applicable for Christmas deliveries. 

6.4. If we are unable to deliver to you, or have to deliver late, for reasons beyond our control, we will not, of course, charge for products unless or until we have delivered them to you.

6.5. We will not charge you for incorrect products (products that you have not ordered and substitutes for those products which substitutes are not acceptable to you) or products which we have not delivered in accordance with these T&Cs. Otherwise our liability in respect of incorrect delivery is limited to the price of the incorrect products.

6.6. You must inspect the products as soon as possible after delivery and notify us promptly if you find any defects, by calling us, emailing us or writing to us.The telephone number and address are shown on our website. We will replace or refund you for defective products. 

6.7 We recommend that all Fruit, Salad and Vegetables are washed before eating.


7. Availability of the Website

7.1. Northern Harvest aims to offer you the best service we can.We cannot guarantee that the service will work at all times. If a fault occurs in the service, please report it to us (see below for contact details) and we will correct it as soon as we reasonably can.

7.2. Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we reasonably can. In the event that our website is unavailable, our usual order and cancellation deadlines still apply; please notify us of changes to your order, or any new orders via email (
enquiry@northernharvest.co.uk) or telephone (01925 764811).


8. Cancellation rights

8.1. Northern Harvest may suspend or cancel any accepted order or your registration immediately at our reasonable discretion or if you breach any of your obligations under these T&Cs.

8.2. You can cancel your registration with us at any time by writing to us or calling us. If you do so, you must stop using Northern Harvests services.   

8.3. Any rights or liabilities up to the date of cancellation will be unaffected.


9. Warranties/Liabilities

9.1. Whilst we try toensure that all published information is correct, we cannot accept responsibility if, despite our endeavours, this is not the case. This does not affect your statutory rights. We can’t be held liable for any inaccuracies, errors or any technical problems you may experience with the website.

9.2. We warrant that the products will be of satisfactory quality and, therefore, if the products which you purchase from us are faulty or defective you should notify us as soon as possible. Any faulty products will be replaced or refunded. Any warranty is restricted to the value of the faulty products supplied.


No clauses in these T&Cs affect your statutory rights.

9.3 This warranty does not apply to faults or defects which been caused by your mis-use or neglect of the products or by accidents caused while the products are in your possession.

9.4 Nothing in these Terms and Conditions means that our liability to you for death or personal injury resulting from our negligence or that of our employees, agents or subcontractors is limited.

9.5 We shall not be liable for any delay or failure in the performance of our obligations due to events beyond our reasonable control.


9.6 These T&Cs shall be governed by and construed in accordance with the laws of England.

9.7 You may not assign, sub-license or otherwise transfer any of your rights under these T&Cs.

9.8 If any provision of these T&Cs is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these T&Cs, which shall remain in full force and effect.

9.9 The provisions of the Contracts (Rights of Third Parties) Act 1999 are expressly excluded from our contractual relationship with you.
